Terms of Service

These terms govern your use of the Biilda desktop application, website, and related services (together, “Biilda” or the “Service”). By creating an account, downloading, or using Biilda you agree to these terms. If you use Biilda on behalf of a business, you agree on that business’s behalf and confirm you have authority to do so. These terms are versioned; if we make a material change we will notify you and may require you to accept the updated terms before continuing.

1. What Biilda is — software that builds and runs software

Biilda generates, modifies, and executes code and automations on your machine, at your direction. You acknowledge and accept that this self-building behavior carries inherent risk: generated code can contain errors, automations can act on real accounts and real data, and Biilda does not run inside a heavy operating-system sandbox. Biilda mitigates these risks with safeguards — automatic snapshots before every change, a sandboxed development mode, health checks, and an Approvals queue for risky actions — but no safeguard is perfect. You are responsible for what you direct Biilda to build, connect, and run, and for reviewing outcomes that matter to you.

2. AI output

Content and code produced by AI can be inaccurate, incomplete, or unsuitable for your purpose despite passing automated tests. You should review AI output before relying on it for consequential decisions (financial, legal, medical, or otherwise). Biilda provides tools — approvals, dry-run testing, logs, and backups — to help you verify behavior before and after it goes live; using them is your responsibility.

3. Prompt injection — a risk you must understand

AI employees you create can read external content: emails, web pages, chat messages, documents. Any of that content can contain text written by a third party that attempts to manipulate an AI into taking unintended actions (“prompt injection”). Biilda defends against this by treating ingested content as data rather than instructions, and by defaulting every newly created AI employee to require your approval before outward actions (sending, posting, or spending). You may relax that approval default per employee; if you do, you accept the increased risk. These defenses reduce but cannot eliminate the risk, and we are not liable for actions an AI employee takes as a result of content supplied by third parties.

4. Your data stays local — and that has consequences

Your workflows, AI employees, features, connector configurations, operational history, and secrets live on your machine, not on our servers. We cannot see, recover, or restore them. Backups in this version of Biilda are local only: the app snapshots your work automatically and lets you export an encrypted backup file, and you are responsible for keeping exports somewhere safe. Loss of your machine without an export means loss of your Biilda workspace; your account, balance, and purchase history survive on our side, but your locally built work does not.

5. Availability — Biilda runs on your computer

Scheduled tasks and AI employees run inside the Biilda app on your machine. If you quit the app or shut down or the computer is otherwise off, nothing runs until Biilda is reopened; the app warns you about this when you quit, and stays resident in your system tray when you close its window. There is no cloud runner in this version. The cloud services we do operate (sign-in, model access, billing) are provided without an uptime guarantee, though we work to keep them reliable.

6. Connectors and third-party services

When you connect Biilda to other apps and services (email, chat, project tools, and so on), you do so under those services’ own terms, and complying with them is your responsibility. You are responsible for the accounts you connect, the permissions you grant, and the actions your automations take through them. Connector credentials are stored in your operating system’s secure storage on your machine; we never receive them.

7. Credits, spend cap, and billing

Biilda is free to download. AI usage is prepaid with credits purchased in US dollars. Credits are a service unit for metering AI usage within Biilda only: they are not money, stored value, or a deposit; they are non-transferable, cannot be redeemed for cash, and have no value outside the Service, except that unused balance is refundable as described in our Refund Policy. A server-enforced spend cap guarantees you can never be charged more than the balance you have added. When your balance runs out, in-progress work pauses safely and resumes when you top up — it is never lost, and restoring from a backup is always free. Purchases are processed by our payment provider acting as merchant of record; their name may appear on your statement. Any currency conversion or foreign-transaction fees are charged by your bank and are outside our control. Prices, credit packs, and the AI models behind each quality tier may change; tiers describe a level of quality and cost, not a specific model.

8. Updates

App updates are delivered as signed installers and are installed only with your consent — never silently. Updates replace only the software we ship; everything you have built and your data live outside the application bundle and are never overwritten by an update. If anything goes wrong after an update, Biilda asks you whether to roll back or let the AI repair it — the choice is always yours, and the previous version is retained until you confirm the update is healthy.

9. Acceptable use

You may not use Biilda to break the law, to send spam or unsolicited bulk messages, to harass or harm others, to infringe intellectual-property rights, to probe or overload our infrastructure or evade our rate limits, or to build automations that violate the terms of the services they connect to. We may suspend or terminate accounts engaged in fraud or abuse. If we terminate your account for reasons other than fraud or abuse, we will refund your unused balance.

10. Your account

You are responsible for safeguarding your account credentials and for activity under your account. You must provide accurate account information and be at least 16 years old (or the age of digital consent in your jurisdiction) to use Biilda.

11. Intellectual property

Biilda and its underlying software remain ours. What you build with Biilda is yours: the features, workflows, employees, and content generated in your workspace at your direction belong to you, to the extent we hold any rights in them we assign or license them to you, and nothing you build is uploaded to us. You grant us no rights over your local work.

12. Disclaimer of warranties

Biilda is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that generated code will be error-free, that automations will behave as intended, or that the Service will be uninterrupted. Some jurisdictions do not allow certain warranty exclusions; where they apply, exclusions are limited accordingly.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of Biilda — including actions taken by automations or AI employees you created or approved. Our total aggregate liability for all claims relating to the Service is limited to the greater of the amounts you paid us in the twelve months before the claim or fifty US dollars. Nothing in these terms limits liability that cannot lawfully be limited, including for willful misconduct or gross negligence.

14. Indemnity

You will indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from automations you direct, accounts and services you connect, content you process, or your violation of these terms or of a third party’s rights or terms of service.

15. Governing law and disputes

These terms are governed by the laws of [jurisdiction — to be confirmed on legal review]. Before filing a claim, you agree to contact us and give us 30 days to work it out informally. [Dispute-resolution forum, arbitration terms, and class-action waiver to be finalized on legal review; a waiver will apply only where enforceable.]

16. Changes and contact
